What Compensation Can Families Recover After a Fatal Crash in Austin, TX?
After a fatal crash in Austin, families may recover compensation for lost financial support, loss of companionship, mental anguish, and funeral costs when another party is legally responsible for the death. These damages address losses resulting from the death.
Under Texas law, the surviving spouse, children, or parents may file a wrongful death claim. If none of them files within three months, the estate’s representative may file unless eligible family members request otherwise.
Beyond the wrongful death claim, the estate may bring a separate survival claim for losses the person had before death. These may include medical bills, pain, and other damages the person could have recovered if they had lived.
If the claim succeeds, each eligible family member’s award is based on that person’s own loss rather than one amount divided equally. The amounts may differ based on each family member’s individual relationship and losses.
In rare cases, exemplary damages may be available when gross negligence caused the death, such as when a driver was drunk. Texas law may limit which eligible family members can receive these additional damages.
In Texas, families generally have two years from the date of death to file a wrongful death lawsuit. Missing this deadline can prevent surviving family members from recovering compensation.
As the claim moves forward, a wrongful death lawyer can review the available insurance and help your family understand what compensation may be available. An attorney can also handle communications with insurance companies on your family’s behalf.
