What Compensation Can Families Recover After a Fatal Crash in Baytown, TX?
After a fatal crash in Baytown, families may recover compensation for lost financial support, loss of companionship, mental anguish, and funeral costs. These losses reflect how a death changes a family's finances and daily life.
Under Texas law, the surviving spouse, children, or parents may file a wrongful death claim. If none of them files within three months, the estate’s representative generally must bring the claim unless all eligible family members request otherwise.
Along with the family's claim, the estate may bring a separate survival claim for losses the person experienced before death, such as medical bills and physical pain. It addresses harm to the person, not the family's own losses.
If the claim succeeds, each family member's award is based on their own loss, rather than one amount split evenly. A spouse, child, and parent may each receive different amounts, depending on how the death affected them.
In most cases, families have two years from the date of death to file a wrongful death lawsuit. Missing that deadline can prevent a family from filing the claim.
When a family is unsure which losses they can recover after a fatal crash, a wrongful death lawyer can review their case and explain what compensation may be available. An attorney can also help determine who may be responsible and negotiate with the insurance company on the family’s behalf.
