What Compensation Can Families Recover After a Fatal Car Accident in Chico, TX?
After a fatal car accident in Chico, families may be able to recover compensation for lost financial support, care and companionship, mental anguish, and loss of inheritance. Funeral costs may also be available, depending on the claim.
As for who can file, the surviving spouse, children, or parents may bring a wrongful death claim under Texas law. Each eligible relative's losses matter, even when one person takes the lead in filing the case.
Beyond what the family lost, the estate may have a separate claim for medical bills and suffering the person experienced before death. That claim addresses losses belonging to the deceased person and is handled separately from the relatives' claims.
Under Texas law, families generally have two years after the date of death to file a wrongful death lawsuit. Some circumstances affect the deadline, so keeping accident and medical records together can help when your family considers its options.
As the claim develops, a wrongful death lawyer can explain which losses may belong to surviving family members and which may belong to the estate. A lawyer can also address questions about fault and available insurance.
