Why Uninsured Motorist Coverage Deserves a Look in El Paso, TX

Texas requires drivers to carry liability insurance, but the minimum limits are modest: $30,000 for one injured person, $60,000 for all injured people combined, and $25,000 for property damage.

A serious injury can produce medical bills that exceed those numbers quickly. Some drivers also carry no insurance at all, which leaves the injured person with few places to turn for payment.

Uninsured and underinsured motorist coverage (UM/UIM) is designed to fill that gap. Texas law requires insurers to offer it with auto policies, and a driver who does not want it must reject it in writing.

Depending on the policy terms, it may apply when the at-fault driver has no insurance, has too little to cover the losses, or cannot be identified.

A UM/UIM claim is still a claim against an insurance company, and it comes with its own hurdles. The insurer may ask for proof that the other driver lacked coverage, and the policy usually sets notice and cooperation requirements.

Texas follows a proportionate responsibility rule that can bar recovery when a person is found more than 50 percent at fault, so the question of who caused the harm often shapes the outcome. A car accident lawyer can review the declarations page, confirm whether coverage was ever rejected in writing, and help organize medical records and other documents for the insurer.
