What Compensation Can I Recover After a Car Accident in Austin, TX?

After a car accident in Austin, you may be able to recover compensation for medical costs, lost income, property damage, pain and suffering, and other losses caused by the collision.

Because Texas uses an at-fault system, the responsible driver’s liability insurance may cover qualifying losses. Personal injury protection, if included in your policy, may also help with certain early expenses regardless of who caused the crash.

If the other driver has little or no insurance, uninsured or underinsured motorist coverage may help cover losses that would otherwise remain unpaid. The amount available depends on the terms and limits of your policy and any other applicable coverage.

To support your claim, keep police reports, photos, witness information, bills, and other records connected to the crash. These materials can help show what happened and document the financial losses included in your claim.

In some cases, punitive damages may also be available when the conduct that caused the crash was especially serious. These damages are not available in every case and depend on the facts surrounding the collision.

Even if you share some responsibility, you may still recover compensation in Texas. Your recovery is reduced by your percentage of fault, but you cannot recover if you are found more than 50% responsible for the harm.

Before you accept a settlement offer, a car accident lawyer in Austin can determine whether it reflects the full extent of your documented losses. An attorney can also handle insurance calls and paperwork so you can focus on your recovery.
