How Do Wrongful Death Claims Work After a Fatal Crash in Dallas, TX?
After a fatal crash in Dallas, a wrongful death claim allows eligible family members to seek compensation from the party responsible for the death. The claim usually goes through that party's insurer and may end in a settlement or lawsuit.
Under Texas law, the surviving spouse, children, or parents may file a wrongful death claim. If none files within three months, the estate's representative must generally pursue the claim unless all eligible family members request otherwise.
Depending on the family's losses, compensation may include lost financial support, loss of companionship, mental anguish, and the value of care and services the deceased would have provided. Reasonable funeral expenses may also be recoverable when paid by eligible family members.
In most cases, families have two years from the date of death to file a wrongful death lawsuit in Texas. Certain exceptions may apply. Missing this deadline can prevent eligible family members from recovering compensation through a lawsuit.
If an insurance company disputes fault or the value of your family's losses, a wrongful death lawyer can look at the available information and communicate with the insurer on your behalf. An attorney can also explain who has the right to file and what the claim may include.
