How Is Fault Determined After a Two-Car Crash in Laredo, TX?

After a two-car crash in Laredo, fault is determined by examining what each driver did before the collision and whether traffic laws were followed. Both drivers may share responsibility depending on the evidence. A clear account also carefully considers traffic signals, turning movements, road conditions, and whether either driver had time to react. No single piece of evidence decides every collision.

To piece together what happened, police and insurers may examine the crash report, photographs, video, witness statements, and damage to both vehicles. These records can help establish the sequence of events. It helps to save copies before they disappear.

When an insurance company contacts you, share the basic facts without guessing about the collision or accepting blame. You can politely decline a recorded statement until you have received advice from a lawyer.

If you share some of the blame, Texas generally reduces your compensation by your share of responsibility. You cannot recover damages if you are found more than 50 percent at fault.

While fault is being decided, your personal injury protection coverage may help pay medical bills and lost income regardless of who caused the crash. Texas policies include PIP unless you rejected it in writing.

Under Texas law, you usually have two years to file a personal injury lawsuit after a car accident. Missing the deadline may prevent you from seeking compensation in court.

When fault is unclear, a car accident lawyer can look into how the crash happened and identify problems with the insurance company’s findings. An attorney can also determine which insurance policies may cover the accident and help preserve important evidence.
