Types of Damages Texas Law Allows After Highway Crashes in El Paso, TX

Compensation in a Texas injury claim is generally sorted into economic and non-economic damages. Economic damages cover measurable losses such as medical bills, lost wages, and reduced earning capacity. Non-economic damages address harder-to-price harms like physical pain, mental anguish, impairment, and disfigurement.

Counting medical expenses is less simple than adding up invoices. Texas law generally limits recovery for medical costs to the amounts actually paid or incurred, so the figure on a hospital bill and the figure a claim can include may differ. Ongoing needs such as therapy, follow-up visits, or future procedures may also factor in, and they usually need supporting records from a treating provider.

Exemplary damages are a separate category, reserved for rare cases involving fraud, malice, or gross negligence that must be proved by clear and convincing evidence. Texas also limits them by formula. For drivers who drive around El Paso, most claims will turn on economic and non-economic losses, and a car accident lawyer can help document each category and explain how Texas limits may apply to the numbers.

If you are wondering which losses may count toward your case, Brian C. Gutierrez, PLLC, can walk you through how Texas damages are categorized and what records may support your specific situation.
