How Can a Move Over Law Violation Affect an Accident Claim in Montgomery County, TX?
A move-over law violation can help show that a driver failed to follow traffic safety rules. This may strengthen your injury claim by helping establish that the driver acted carelessly and failed to take reasonable precautions.
Under Texas law, drivers approaching stopped emergency vehicles, tow trucks, or certain highway work vehicles with flashing warning lights must move over or slow down. If the speed limit is 25 mph or higher, drivers who cannot move over must slow down to 20 mph below the posted limit. On roads with lower speed limits, they must slow to 5 mph.
When someone is injured while working on the roadside, they may have more than one option for covering their losses. First responders, tow truck drivers, and highway workers may qualify for workers' compensation benefits. They may also be able to file a separate injury claim against a negligent driver, depending on what happened.
To show that a violation happened, you can use police reports, dashcam or body camera footage, and witness statements. The positions of the vehicles can also help explain how the crash happened and whether the driver followed the required safety rules.
If more than one person shares the blame, Texas law reduces the damages you can recover based on your share of fault. For example, if you are found 20% responsible, your damages are reduced by 20%. You generally cannot recover damages if you are more than 50% responsible.
Because move-over cases often depend on traffic laws and police findings, a car accident lawyer can help build a clear case for you. An attorney can also handle settlement talks with the insurance company on your behalf.
