What Should You Do After a Car Accident in Decatur, TX?

After a car accident in Decatur, knowing what steps to take can help protect your health and preserve information that may be important for an insurance claim. Even if injuries are not immediately obvious, it is wise to take the situation seriously.

First, check for injuries and call 911 if emergency assistance is needed. Move to a safe place if possible, but avoid moving anyone who may have a serious injury unless there is an immediate danger. Follow instructions from emergency personnel and seek medical attention if symptoms develop after the accident.

When it is safe, exchange contact and insurance information with the other driver. Photograph vehicle damage, road conditions, traffic signs, and the positions of the vehicles, if possible. If witnesses are present, consider collecting their contact details. Keep copies of medical records, repair estimates, bills, and insurance correspondence.

Texas follows a modified comparative responsibility rule. An injured person may generally recover damages if they are no more than 50% responsible for the accident, although compensation can be reduced according to their share of fault. If they are more than 50% responsible, recovery is generally barred under this rule.

Finally, drivers need to note that Texas generally imposes a two-year deadline for filing a personal injury lawsuit, although exceptions may apply. Keeping records and seeking legal guidance promptly can help protect potential claims.
