Who Pays Funeral Expenses After a Fatal Crash in Harris County, TX?
After a fatal crash in Harris County, funeral costs may be covered by the responsible driver's insurance or your loved one's personal injury protection coverage. Which insurance pays depends on the details of the crash and the policies available. Your family may need to check both options.
Beyond funeral expenses, your family may face medical bills, lost household income, and other financial challenges. If your loved one helped support the household, their death could make it harder to cover daily expenses. A wrongful death claim may help your family recover compensation for these losses.
Your family may also seek compensation for the loss of companionship and emotional support your loved one provided. This may include the pain and mental anguish caused by their death. The amount you may recover depends on your family’s circumstances and the impact of the loss.
A wrongful death claim in Texas can be brought by a surviving spouse, children, or parents. They may file the claim together or separately. If no eligible family member files within three months, the estate's representative may generally file the claim, unless a qualifying family member asks them not to.
Under Texas law, families generally have two years from the date of death to file a wrongful death lawsuit. Missing that deadline may mean losing the chance to bring the claim to court. Knowing how much time your family has can help you decide what to do next.
When the process starts to feel overwhelming, a wrongful death lawyer can identify insurance coverage and coordinate the family and estate claims. An attorney can also help your family avoid filing mistakes.
