What Legal Options May Be Available to Families After a Fatal Truck Crash in Tornillo, TX?

When a person dies in a collision involving a commercial truck, eligible surviving family members may be able to pursue a wrongful death claim. Depending on the circumstances, a separate claim may also be available to address losses connected to the person's final injury and death.

A wrongful death claim may seek compensation for losses such as lost financial support, loss of companionship, and other harm recognized by law. Certain damages related to the deceased person's final medical expenses, lost earnings before death, or other losses may be addressed through a separate estate claim.

Establishing responsibility after a crash involving a pickup truck and a semi-truck may require a careful review of the circumstances. Relevant evidence can include the crash report, photographs, witness statements, vehicle damage, roadway conditions, and available camera footage. If a commercial vehicle was involved, records relating to the truck, its driver, and the carrier may also be relevant, depending on the facts.

Potential liability may extend beyond one driver if evidence shows that another party's negligence contributed to the collision. However, the involvement of a commercial truck does not automatically establish fault on the part of the driver or trucking company. Responsibility must be assessed using the available evidence and applicable law.

Families may find it helpful to preserve documents related to the crash, funeral and burial expenses, financial support, and any communications with insurance companies. They should avoid discarding relevant records and keep copies of documents received from insurers or other parties.

Texas law sets deadlines for filing wrongful death and related claims, and exceptions may apply in certain circumstances. Promptly reviewing the applicable deadlines and potential claims can help families understand their options.
