Who Can File a Wrongful Death Claim in Newton County, TX?

In Texas, a wrongful death claim belongs to the surviving spouse, children, and parents of the person who died. Siblings and other relatives generally cannot file one. The deadline is usually two years from the date of death.

Eligible family members can bring one lawsuit together, and any recovery is generally meant for the benefit of the spouse, children, and parents. Damages may include lost financial support, loss of companionship, and mental anguish, depending on the facts.

A separate claim, commonly called a survival action, belongs to the estate and may cover the deceased person's own medical bills and funeral costs.

Disputes tend to come up over who qualifies. Adult children, blended families, and parents who lived apart can raise questions, and an unmarried partner generally cannot bring a wrongful death claim alone. A wrongful death lawyer can review family relationships, coordinate with whoever is appointed to handle the estate, and help keep both types of claims within the time Texas allows.
