Wrongful Death Claim Filing Deadlines in Prairie View, TX

A wrongful death claim in Texas runs on a short clock. State law generally requires a lawsuit to be filed within two years of the date the person died, and a claim filed after that point can be barred entirely. The clock typically starts on the date of death, which can differ from the day the injury happened if the person survived for a time.

It is crucial to consider that other deadlines can arrive much sooner, though. If a government entity may share responsibility, Texas law typically requires written notice of a claim within six months, and some city charters set even shorter windows.

Separately, an estate's claim for the losses a person endured before dying is generally measured from the date of the injury rather than the date of death. Texas also allows the executor of an estate to bring a wrongful death claim if no family member has filed within three months of the death, unless the family asks that it not be filed.

Families tend to spend the first months handling funeral arrangements, insurance calls, and estate paperwork, so deadlines can pass quietly. Records like death certificates, medical bills, and employment history take time to collect, and some evidence may become harder to find the longer a family waits. A wrongful death lawyer can review the dates involved, identify which deadlines could apply, and help determine whether a notice requirement needs attention first.
