Who Can File a Wrongful Death Claim in Waco, TX?
In Waco and throughout Texas, the surviving spouse, children, and parents of someone who died due to another person’s negligence or wrongdoing may file a wrongful death claim. Texas law allows these family members to seek compensation.
If several family members qualify, one or more may file a wrongful death lawsuit on behalf of everyone entitled to compensation. Each family member does not need to file a separate lawsuit to be included in the claim.
If no eligible family member files within three months, the deceased person’s executor or administrator generally must file the lawsuit unless all eligible family members ask them not to. This does not make the estate representative a beneficiary.
Depending on the family’s losses, compensation may include lost financial support, companionship, guidance, and mental anguish. The amount each eligible family member may recover depends on their individual losses and the circumstances surrounding the death.
Under Texas law, you generally have two years from the date of death to file a wrongful death lawsuit, although some exceptions may apply. The three-month rule only affects who can bring the claim, not how long you have to file it.
A wrongful death lawyer can help your family figure out who has the legal right to file and guide you through each step of the claim. An attorney can also handle insurance negotiations and prepare the necessary legal paperwork.
