Who Can File a Wrongful Death Claim in Dallas, TX?

In Dallas and throughout Texas, a surviving spouse, children, or parents may file a wrongful death claim when another person or company is legally responsible for a death. One eligible relative may also file on behalf of all qualifying family members under Texas law.

When several relatives are eligible, they may bring the claim together or allow one qualifying family member to file for the group. Texas law does not require each eligible relative to bring a separate wrongful death action.

As the claim moves forward, it focuses on losses experienced by the surviving spouse, children, and parents because of the death. Each eligible family member may have different losses depending on the relationship and circumstances.

If no eligible relative files within three months, the executor or administrator of the estate generally must bring the action unless all eligible family members request that no claim be filed.

Because Texas law limits who may file, siblings, grandparents, and other extended relatives generally do not have their own right to bring a wrongful death claim. Their relationship to the person who died does not by itself make them eligible beneficiaries.

When fault is disputed, the claim may depend on showing that another party’s wrongful act, neglect, carelessness, or lack of skill caused the death. The legal basis for the claim must be established before wrongful death damages may be recovered.

Because Texas law allows only certain relatives to file, a wrongful death lawyer can review your family's situation and explain who qualifies. An attorney can also communicate with the insurers and file the required documents on time.
