What Compensation Can Families Recover After a Fatal Crash in Houston, TX?

After a fatal crash in Houston, eligible family members may recover compensation for lost financial support, loss of care and services, loss of companionship, and funeral and burial expenses. The amount recoverable depends on the circumstances of the crash and the losses each family member has experienced.

Under Texas law, a surviving spouse, children, and parents may bring a wrongful death claim when another party is legally responsible. These rights apply to specific relatives, not every member of the extended family.

To support a family’s claim, crash reports, available video, financial records, and details about household contributions may help establish responsibility and show the extent of the family’s losses.

Beyond the wrongful death claim, a survival claim may cover losses the deceased person experienced before death, such as qualifying medical expenses or conscious pain. These differ from losses claimed by surviving relatives.

In Texas, families generally have two years from the date of death to file a wrongful death lawsuit, although exceptions may apply. Missing the applicable deadline may prevent the family from recovering compensation through the courts.

Because filing requirements can be confusing, a wrongful death lawyer can review the circumstances, identify applicable deadlines, and prepare the required paperwork. An attorney can also keep the family informed throughout the process.
