Who Can File a Wrongful Death Claim in Conroe, TX?
In Conroe and throughout Texas, the surviving spouse, children, and parents of someone who died can file a wrongful death claim. This gives certain family members a way to seek financial recovery after losing a loved one.
In Texas, eligible family members can file together or separately. Even if only one person files, the claim is still brought for the benefit of everyone who is legally entitled to share in it.
If no family member files within three months, the executor or administrator of the estate generally must bring the claim unless all eligible family members ask that no wrongful death action be filed.
In addition to a wrongful death claim, the estate may bring a separate survival claim for losses your loved one experienced before death. These may include medical bills and conscious pain and suffering, if supported by evidence.
Depending on the circumstances, your family may be able to recover compensation for lost financial support, the loss of love and companionship, and the mental anguish of losing someone close to you.
Under Texas law, you generally have two years from the date of your loved one's death to file a wrongful death lawsuit. Some exceptions may apply, but missing the deadline could prevent your family from pursuing the claim.
As the claim moves forward, a wrongful death lawyer can look at the available evidence, identify potentially responsible parties, and address insurance issues. An attorney can also explain who should bring the claim and what steps may be required.
