How Can Injured People Seek Compensation After a Dallas Crash?
People injured in a Dallas crash may be able to seek compensation from an at-fault driver's insurance company when negligence contributed to the collision. Depending on the circumstances, available damages may include medical expenses, lost wages, future treatment costs, and compensation for physical pain and mental anguish.
In a two-vehicle crash, insurance companies may examine the actions of both drivers before determining liability. Evidence such as photographs, witness statements, vehicle damage, traffic camera footage, and crash reports may help establish how the collision occurred. Texas follows a modified comparative negligence rule, meaning an injured person may recover damages if they are not more than 50 percent responsible. Any recovery may be reduced by their share of fault.
Medical records can help document the extent of injuries and the treatment required. People receiving hospital care or follow-up treatment may wish to keep copies of medical bills, physician records, prescriptions, and recommendations for additional care. Records of missed work and other financial losses may also support a claim.
It is often helpful to preserve available evidence and avoid accepting a settlement before the full extent of an injury is known. Early settlement offers may not account for future medical needs, ongoing limitations, or lost earning capacity. Texas generally has a two-year statute of limitations for personal injury lawsuits, though exceptions can apply.
