What Legal Options Do Injured Passengers Have After a Crash in Midland, TX?

After a crash in Midland, an injured passenger may be able to file a claim against the driver of the vehicle they were riding in, the other driver, or both, depending on who caused the collision.

Depending on the coverage available, PIP from the vehicle’s policy or the passenger’s own policy may help pay early medical bills in Texas. Health insurance may also cover treatment while an injury claim remains open, subject to the policy terms.

If the at-fault driver has no insurance, uninsured motorist coverage from the vehicle’s policy or the passenger’s own policy may help cover qualifying losses. Underinsured motorist coverage may apply when the responsible driver has insurance but not enough coverage.

Along with medical costs, an injured passenger may seek compensation for lost income, pain and suffering, and other losses caused by the collision. The amount available depends on the injuries, financial losses, and circumstances of the passenger’s claim.

For personal injury claims, Texas generally allows two years from the date of the collision to file a lawsuit. Certain circumstances can affect the deadline, so the time available may differ depending on the facts of the case.

Because insurers may question your injuries, a car accident lawyer can review your medical records and show how the crash caused them. An attorney can also handle the insurance paperwork while you focus on your recovery.
