Can Families Recover Compensation After a Fatal Hit-and-Run in Webster, TX?
Yes, after a fatal hit-and-run in Webster, families may still recover compensation even if the driver is never found. Your family may qualify for uninsured motorist (UM) coverage under your loved one’s policy or a household member’s policy. Personal injury protection (PIP), if available, may also help pay medical bills and funeral expenses up to the policy limit.
To help identify the driver and support the claim, evidence from the crash can be useful. This may include surveillance or doorbell footage, witness statements, vehicle parts left behind, and the police report.
If police identify the driver, your family may be able to pursue compensation through that driver’s insurance. This insurance claim is separate from any criminal charges or court proceedings. Your family’s claim does not have to depend on a criminal conviction.
In Texas, a wrongful death claim can be brought by the surviving spouse, children, or parents. If none of them files within three months, the estate’s representative may file unless the eligible family members request otherwise. This gives families another way to pursue a claim after losing someone.
Depending on the circumstances, your family may be able to recover compensation for lost financial support, loss of companionship and care, mental anguish, and funeral and burial expenses.
As the claim moves forward, a wrongful death lawyer can gather evidence that may help identify the driver. An attorney can also find out which insurance coverage applies and deal with the insurance companies for your family.
