Who Can File a Wrongful Death Claim in El Paso, TX?

In El Paso and throughout Texas, the surviving spouse, children, and parents of a person who died may file a wrongful death claim. This applies when another party may be legally responsible for the death.

These relatives may file separately or together. One or more of them can also bring the claim for the benefit of all eligible family members. This allows the case to move forward without requiring each person to file separately.

If no eligible family member files within three months of the death, the estate's executor or administrator generally must bring the claim. Family members may instead ask the representative not to file. Texas law requires all eligible family members to make that request together.

Through a wrongful death claim, families may recover damages for lost financial support, loss of care and services, loss of companionship, mental anguish, and funeral expenses. The amount depends on the losses tied to the death and the specific facts of the case.

Because a survival claim is separate from a wrongful death claim, the estate may also pursue certain losses the person experienced before death. These can include medical expenses, lost earnings, and other damages that arose before the person died.

In addition, Texas gives families two years from the date of death to file a wrongful death lawsuit. Missing that deadline can prevent the claim from moving forward. Limited exceptions may apply, so families should confirm the deadline early.

When family members disagree about who should file, a wrongful death lawyer can explain how Texas law applies and help organize the claim. An attorney can also handle communication with insurance companies and required filing steps.
