Why Evidence Can Disappear Quickly After an Accident in Cypress, TX
Much of the proof that shows how two vehicles came together doesn't last long. Skid marks fade, debris gets swept away, and damaged cars may be repaired or sold for scrap within weeks. Business security systems tend to record over their footage after a few days, and a vehicle's event data recorder can be lost if an insurer declares the car a total loss and sends it to salvage.
Texas courts recognize a duty to preserve evidence once a party knows, or reasonably should know, that a claim is likely. If evidence is lost or destroyed after that point, a judge may let the jury assume the missing material would have been unfavorable to the party that failed to keep it. That remedy is usually reserved for more serious cases. A written preservation request, typically called a spoliation letter, puts the other driver and their insurer on notice early.
To avoid losing key evidence, a car accident lawyer can step in and identify which cameras may have captured the moment, send preservation requests to businesses and insurers, and arrange for an expert to download vehicle data before a car leaves the tow yard.
Evidence that is not saved early can be hard or impossible to recover later. If you have been involved in a crash and are not sure of what evidence to preserve, our team at Brian C. Gutierrez, PLLC is open to help you.
