Who Can File a Wrongful Death Claim in Euless, TX?
In Euless and throughout Texas, certain family members can file a wrongful death claim after losing a loved one in a commercial vehicle crash. The surviving spouse, children, and parents may file the claim together or separately.
Along with biological family members, adopted children and adoptive parents also have the right to file. However, siblings, grandparents, and other relatives generally cannot bring a wrongful death claim in Texas.
In some cases, no eligible family member files within three months of the death. When this happens, the executor or administrator of the estate may file, unless a family member asks them not to.
Apart from the wrongful death claim, the estate may file a survival claim. This claim covers losses the person suffered before death, such as medical bills, lost wages, and pain and suffering.
Depending on the family's losses, a wrongful death claim may help recover lost financial support, loss of companionship, and mental anguish. Funeral and burial costs may also be included. In some cases, families may also recover the inheritance the person would likely have saved.
Under Texas law, families generally have two years from the date of death to file a wrongful death lawsuit. Missing this deadline may mean losing the chance to bring the claim to court.

After a fatal truck crash, trucking companies and insurers may try to reduce the compensation they pay. A wrongful death lawyer can help your family seek fair compensation, explain who can file a claim, and gather evidence to support it.
