Who Can File a Wrongful Death Claim in Fort Bend County, TX?

In Fort Bend County and throughout Texas, a deceased person’s surviving spouse, children, and parents may file a wrongful death claim. The claim may seek compensation for the financial and personal losses each eligible family member has experienced.

If no eligible family member files within three months of the death, the executor or administrator of the estate generally must bring the claim. All eligible family members can direct that representative not to file it.

When one eligible relative begins a claim, the case can include the interests of the other relatives who qualify. Identifying everyone who may have a right to recover can help keep the claim organized as it moves forward.

Beyond the wrongful death claim, the estate may also have a survival claim. This claim may address losses the deceased person could have pursued before death. Texas generally allows two years from the date of death to file a wrongful death lawsuit.

Because a commercial truck was involved, records from the truck, driver, and trucking company may help clarify what happened. Driver logs, inspection records, electronic data, and company records may all become relevant.

During the legal process, questions often come up about who can file a wrongful death claim and what role the estate plays. A wrongful death attorney can review your family’s circumstances, walk you through the filing process, and address insurance issues.
