How Long Do Families Have to File a Wrongful Death Claim in Port Bolivar, TX?

In Port Bolivar and throughout Texas, families generally have two years after a loved one's death to file a wrongful death lawsuit. Missing that deadline may prevent the family from pursuing compensation through the court.

In most cases, the deadline begins on the date the person died, which differs from the crash date if death came later. Keeping both dates in your records can establish the timeline.

In some situations, the deadline works differently, and claims involving government vehicles may require written notice within six months or another applicable period. Other exceptions depend on the circumstances, so the deadline should be considered in light of the specific case.

In Texas, a wrongful death claim can be brought by the surviving spouse, children, or parents of the person who died. If none files within three months, the estate's representative may bring a claim unless the family members ask otherwise.

Because evidence can fade over time, accident reports, video, photographs, and witness accounts can become harder to find. These materials help explain what happened and the family's loss.

If the deadline passes, a court will usually dismiss a wrongful death lawsuit filed too late. Families can face additional difficulties even when they have strong evidence, making it important to understand the applicable filing date.

Before an important deadline approaches, a wrongful death lawyer can review the case, determine the applicable filing deadline, and help families take the necessary steps to file a claim on time.
