How Long Do Families Have to File a Wrongful Death Claim in Houston, TX?

Texas generally gives families two years from the date of death to file a wrongful death lawsuit. That deadline comes from the state's civil statute of limitations and usually keeps running while insurance negotiations are underway. Some claims, such as those that involve a government employer, can carry much shorter notice requirements.

Inside that window, a separate three-month rule affects who files. A wrongful death suit may be brought by the surviving spouse, children, or parents. If none of them files within three months of the death, the executor of the estate may file, unless the family asks that no suit be brought.

The estate's own survival claim, which can cover losses the person experienced before dying, generally follows the same two-year limit and requires someone with legal authority to act for the estate.

The clock can pause in limited situations, such as when a beneficiary is a minor, but courts apply those exceptions narrowly, so families should not count on extra time. A wrongful death lawyer can help work out the date a deadline began, identify which notice rules may apply, and plan the steps to take well before time runs out.

Filing deadlines can pass quietly while a family handles funeral arrangements and paperwork. At Brian C. Gutierrez, PLLC, we can explain how the filing deadlines may work for your specific situation.
