How Is Fault Determined in an 18-Wheeler Crash in Abilene, TX?

Fault in an 18-wheeler crash in Abilene is determined by establishing whose unsafe actions caused or contributed to the collision. Responsibility depends on each driver’s actions before the collision.

To establish what happened, crash reports, vehicle damage, available video, and truck data can help show how the vehicles moved and what each driver did. This information may help clarify disagreements about the collision.

Along with your medical expenses, a personal injury claim may cover lost income and pain and suffering. If you were injured while working, applicable workers’ compensation coverage may also help pay for necessary medical treatment.

If you are partly at fault, Texas generally reduces your damages based on your percentage of responsibility. However, you cannot recover damages if you are more than 50% responsible for the crash. Workers’ compensation claims follow different rules.
