How Is Fault Divided in Multi-Truck Claims in Lindale, TX?
Texas divides fault by percentage when more than one driver or company shares blame. Each party gets a share of responsibility, and that includes the person bringing the claim. If you are found more than 50% at fault, you cannot recover damages. If you are at 50% or less, your award goes down by your own percentage.
Commercial truck cases usually involve more parties than a typical car claim. One tractor-trailer can involve a driver, a motor carrier, a trailer owner, a cargo loader and a maintenance shop, and every extra truck adds to that list.
A Texas jury can give each of those parties a percentage of fault. A defendant can also ask to add a "responsible third party" who was never sued. If a company is found more than 50% responsible, they can be made to pay the full damages, while the others usually pay only their own share.
When a collision involves several big rigs, each insurer tends to blame the others, and a few percentage points can decide whether someone recovers anything at all.
Electronic logging device data, dashcam video and hours-of-service logs may show which driver or carrier fell short. A truck accident lawyer can gather those records, bring in reconstruction experts when needed and question fault estimates that don't match the evidence.
