How Wrongful Death Claims Work in Austin, TX

Wrongful death claims in Texas are governed by a statute that allows certain family members to seek compensation when a person's death was caused by another's wrongful act, neglect, carelessness, or default.

The surviving spouse, children, and parents of the deceased may bring the claim, while siblings and other relatives generally may not. If none of them files within three months of the death, an executor or administrator generally files it unless the family asks that it not be filed.

Texas law recognizes several categories of damages in these claims. Family members may seek compensation for lost financial support, loss of companionship, mental anguish, and, in some cases, loss of inheritance, and exemplary damages may be available when the death resulted from gross negligence or a willful act.

A separate survival action, brought by the estate, can address the deceased person's own medical bills, funeral costs, and pain before death, so the two claims are typically reviewed together.

Texas generally gives families two years from the date of death to file, and a recovery may be reduced if the deceased person is found partly at fault under the state's proportionate responsibility rules.

Families can turn to a wrongful death lawyer to help them identify who may bring the claim, preserve evidence before it is lost, and explain which damages may be available.
