What Damages Can Families Recover in a Wrongful Death Claim in Austin, TX?
Families can recover both financial and emotional losses when it comes to wrongful death claims. Under Texas law, a spouse, children or parents may ask for the financial support they lost, the value of the household help and guidance their loved one gave, loss of companionship, and mental anguish. Lost inheritance may also be included. Funeral costs and medical bills are usually handled through a separate claim on behalf of the estate.
Financial losses cover the future as well as the past. A claim may include the paychecks, benefits and retirement savings the person would likely have earned over a working lifetime.
It may also include the household chores, help raising children and everyday advice they gave the family. No receipt exists for those future losses, so economists and job experts usually help put a dollar amount on them.
Emotional losses have no set formula. Juries look at how close the relationship was, how much time the family spent together and how daily life changed afterward. In a typical traffic case, Texas generally doesn't cap these damages.
Extra damages meant to punish gross negligence are limited, though, and they require a higher level of proof. Any recovery can also be reduced if the person who was killed shared part of the fault. A wrongful death lawyer can organize that proof and work with experts to present it clearly.
