Who Can File a Wrongful Death Claim in Spicewood, TX?

In Texas, a wrongful death claim may be filed by the surviving spouse, children, or parents of the deceased person. If none of them files within three months, the estate's personal representative may bring the claim. Texas law generally sets a two-year filing deadline, though the facts of each case can change how it applies.

These claims sit alongside a separate survival action, which belongs to the estate rather than to the family members themselves. A survival action may address losses the deceased person experienced before death, such as medical bills, conscious pain and suffering, and funeral costs.

By contrast, wrongful death damages can include lost income and financial support, loss of companionship, and mental anguish for the family. When gross negligence is involved, Texas law may also allow exemplary damages.

Families typically find themselves dealing with insurers, medical providers, and funeral expenses all at once. Records such as the death certificate, medical and funeral bills, pay stubs, and any photographs or video can help show what a family has lost and why.

Texas sets separate rules for who may file and who benefits, so it can help to have a wrongful death lawyer review the family relationships and filing timeline before any settlement discussions begin.

Sorting out who may file a claim, and by when, is easier with someone who works through these questions regularly. Brian C. Gutierrez, PLLC can explain how Texas wrongful death and survival claims may apply to your family’s specific situation.
