Can a Motorcyclist Recover Damages If Partly at Fault in Edinburg, TX?

Yes, in many cases, because Texas follows a proportionate responsibility rule that lets a partly at-fault person still seek compensation if their share of fault is 50 percent or less. A jury assigns percentages to everyone involved, and any award is reduced by the injured person's share. Under Texas law, a person found 51 percent or more responsible cannot recover damages.

Fault arguments tend to follow motorcycle riders, because other drivers usually say they never saw the bike coming. Insurers may point to speed, lane position, or visibility to raise a rider's percentage, even when another driver turned or changed lanes without enough room.

The percentage matters because it feeds directly into the dollar figure. Photos, repair records, witness statements, and medical records can all shape how a fault dispute plays out. A motorcycle accident lawyer can use that material to question an insurer's fault estimate before a claim settles.

Questions about how fault might be assigned in a Texas motorcycle claim can be hard to sort out alone. Brian C. Gutierrez, PLLC can go over the facts with you and explain how proportionate responsibility may apply to your situation.
