Legal Options After a Fatal Two-Vehicle Crash in Houston, TX
When a fatal crash involves two vehicles, surviving family members may have grounds to pursue a wrongful death claim if another party's negligence contributed to the death. The circumstances of the collision and the evidence available can help determine whether a claim may be pursued against one or more parties.
Under Texas law, a wrongful death claim may seek compensation for lost financial support, loss of companionship, mental anguish, and other damages recognized by law. In addition, eligible family members may have a separate survival claim for certain losses the deceased experienced before death. The types of damages available depend on the facts and applicable legal requirements.
Establishing whether another party was responsible is an important part of evaluating these claims. Determining fault may involve reviewing vehicle damage, roadway evidence, witness accounts, available camera footage, and the official crash report. Investigators may also examine the sequence of impacts and other physical evidence to reconstruct how the collision occurred.
Beyond the claims available to surviving family members, the surviving driver may also have a personal injury claim if another party's negligence contributed to the collision. Potential damages may include medical expenses, lost income, future treatment costs, and pain and suffering, depending on the circumstances.
Because these claims involve specific legal requirements, Texas law establishes rules about who may bring a wrongful death claim and sets deadlines for filing. Families may benefit from keeping records of funeral expenses, financial losses, and other documentation related to the death. Preserving relevant photographs, correspondence, and official records may also help support the review of potential claims.
