What Wrongful Death Claims Mean for Families in Whitesboro, TX
After a death caused by someone else's carelessness, families are typically asked to make legal decisions while still arranging funeral services and sorting through bills. Texas allows a wrongful death claim when a person dies because of another party's wrongful act, neglect, carelessness, or default.
Under Texas law, the surviving spouse, children, and parents may bring the claim, and the damages are meant to compensate those family members for their own losses.
Those losses can include lost financial support, loss of companionship and society, mental anguish, and loss of inheritance. Texas may also allow exemplary damages when gross negligence is involved.
Timing matters as well. Texas generally gives families two years to file a wrongful death lawsuit, and the statute lets the estate's personal representative bring the claim if no eligible family member has filed within three months, unless the family asks the representative to wait.
The rules on who may file and who shares in any recovery can get complicated when a family includes adult children or more than one household. Therefore, many families turn to a wrongful death lawyer to review the relationships and the deadline before settlement talks begin.
Questions about who may file a wrongful death claim, and by when, are easier to sort out with someone familiar with Texas law. At Brian C. Gutierrez, PLLC, our team can explain to you how the filing deadline and eligibility rules may apply to your family.
