Defective Products Behind House Fires in Lee County, TX
Many house fires start when an everyday product fails. Space heaters, lithium-ion batteries, dryers, extension cords and electrical panels can overheat or spark if they were poorly designed, built wrong or sold without clear warnings.
Texas law can hold manufacturers responsible for any of those three kinds of defects, even when a family can't show that the company was careless.
Who can be held responsible depends on the role each company played. In Texas, a store that only sold the product is usually shielded. That changes if the store helped design the product, changed it, made its own promises about it, knew about the defect, or if the manufacturer can't be brought into a Texas court.
Product claims also face two time limits. One is the usual two-year deadline after an injury or death. The other generally bars claims filed more than 15 years after the product was sold.
Proving a defect usually comes down to physical evidence. Fire investigators study burn patterns to trace where the fire started, and the charred remains of a heater or outlet can show whether it failed.
That evidence can disappear quickly during cleanup or demolition. Leaving the debris in place gives a wrongful death lawyer time to bring in an independent fire expert to examine it, and that can decide whether a product claim is possible at all.
Product defects can be hard to spot after a house fire in Texas, and the evidence may not last long. Our team at Brian C. Gutierrez, PLLC can explain how a product claim may work and which deadlines may apply to your specific case.
