According to the Bastrop Police Department, a bicyclist was stopped on the improved shoulder adjusting a bicycle chain when a southbound Dodge Ram approached. The teen driver swerved into oncoming traffic to avoid the bicyclist and hit a northbound Nissan Rogue head-on.

The Nissan struck a fence and stopped in a pasture. A northbound Subaru also struck the Ram.

The Nissan driver, a 66-year-old man from Massachusetts, died at the crash site. The Nissan passenger was taken to an Austin hospital. The Ram and Subaru drivers were taken to a local hospital. The bicyclist was not injured.

Authorities are investigating what led to the wreck.

We extend our condolences to the family of the man who lost his life, and we wish those injured a full and steady recovery.

How Long Do Families Have to File a Wrongful Death Claim in Bastrop, TX?

In Bastrop and throughout Texas, families generally have two years from the date of death to file a wrongful death claim. Missing that filing period can prevent the family from pursuing compensation through the courts.

In certain situations, a claim against a government agency may require written notice within six months. The requirement can depend on the government entity involved.

To start the process, the surviving spouse, children, or parents may file the claim. If none files within three months, the estate’s executor or administrator generally must bring the claim unless all eligible family members request otherwise.

Depending on the family’s losses, compensation may include lost financial support, loss of companionship, mental anguish, and funeral costs. The amount depends on the losses caused by the death.

If you are unsure how much time is left, a wrongful death lawyer can review your case and explain the deadline that applies. An attorney can also take care of the paperwork and speak with the insurers on your behalf.
