What Should You Do After a Car Accident in New Braunfels, TX?

After a car accident in New Braunfels, TX, prioritize safety, seek medical attention if needed, exchange information with the other driver, and document the scene when it is safe to do so. These steps can help protect your health, preserve important evidence, and support a potential insurance claim.

Because some injuries may not be immediately apparent, monitor your symptoms and seek medical care if you feel hurt or develop discomfort later. If conditions allow, photograph the vehicles’ positions, visible damage, road conditions, and traffic signs. Exchange contact and insurance information with the other driver, and collect contact details from witnesses.

You should also determine whether the crash must be reported to law enforcement. Texas generally requires reporting qualifying crashes involving injury, death, or property damage that meets the applicable threshold. If an officer investigates, keep any available report information for your records. When discussing the collision, stick to what you know rather than speculating about the cause or accepting blame before the facts are clear.

If you plan to seek compensation, understanding how fault is determined is also important. Texas follows a modified comparative responsibility rule, meaning an injured person may generally recover damages if they are no more than 50% responsible, although compensation is reduced by their share of fault. Those found more than 50% responsible generally cannot recover damages from another party under this rule.

Throughout the process, keep medical bills, repair estimates, insurance correspondence, and records of missed work. These documents can help establish the financial impact of the crash. Texas generally has a two-year deadline for filing a personal injury lawsuit, though exceptions may apply, so it is important to review any applicable deadlines promptly.
