What Legal Options Do Injured Passengers Have After a Crash in San Antonio, TX?

After a car accident in San Antonio, injured passengers can usually file a claim with the insurance company of the driver who caused the crash. This could be the driver of the vehicle they were riding in, another driver, or both.

As soon as you can, get checked by a doctor, even if you don't feel badly hurt. Your medical records show when symptoms began, your diagnosis, and the treatment you received after the crash.

If the vehicle you were in has personal injury protection, it may help pay your medical bills and lost wages, regardless of fault. Texas insurers must offer PIP unless it's rejected in writing. Your own policy may also help.

Depending on your injuries, you may be able to recover compensation for medical bills, lost income, and pain and suffering. If you need ongoing treatment, your claim may also cover future medical costs.

In rare cases, you may qualify for exemplary damages if gross negligence or malice is proven. These damages punish especially wrongful behavior, rather than repay your expenses. Texas law generally limits the amount that can be awarded.

Under Texas law, you generally have two years from the crash date to file a personal injury lawsuit. If you miss that deadline, you may lose your right to seek damages in court, even with a valid claim.

Because passengers may have claims against more than one driver, a car accident lawyer can figure out which insurance companies should cover your losses. An attorney can also file and handle each claim on your behalf.
