What Legal Rights May a Passenger’s Family Have After a Fatal Crash in San Antonio, TX?
When a passenger dies in a motor vehicle crash, surviving family members may have legal options if another party’s negligence or wrongful conduct contributed to the death.
Under Texas law, certain surviving family members, including a spouse, children, or parents, may bring a wrongful death claim when the legal requirements are met. A separate survival claim may also be available through the deceased person’s estate for certain damages associated with the injuries and losses experienced before death.
Potential compensation in a wrongful death claim may include qualifying losses such as lost financial support, loss of companionship, and mental anguish. A survival claim may address damages the deceased person could have pursued, subject to Texas law and the available evidence.
Families may wish to preserve relevant documents, including the official crash report, medical and emergency records, insurance information, and any available witness statements or photographs. If intoxication is suspected, investigative findings and other evidence may be important in evaluating whether a driver or another party may be legally responsible. Families should avoid assuming that a criminal investigation alone will resolve any civil claim.
Texas generally has a two-year statute of limitations for wrongful death and many personal injury claims, although exceptions may apply. Because deadlines and eligibility requirements can vary, obtaining legal guidance promptly may help families understand their options and preserve evidence.
