Which Mistakes Should I Avoid After a Pedestrian Crash in Tyler, TX?

After a pedestrian crash in Tyler, you should avoid skipping medical care, leaving before police arrive, apologizing or admitting fault, posting about the crash online, or accepting a quick settlement. These mistakes could make your claim more difficult.

Under Texas law, your share of fault can reduce the amount you recover. If you are found more than 50% responsible, you cannot recover damages. Insurance companies may use small mistakes to argue that you were partly at fault.

Even though you were walking, personal injury protection (PIP) on your auto policy, or a policy belonging to a relative you live with, may help pay medical bills unless rejected in writing. Your health insurance may also help cover treatment.

Depending on your injuries, you may seek payment for medical expenses, lost income, and pain and suffering through a claim against the driver. If your injuries require ongoing care, your claim may also include future medical expenses.

When gathering evidence, you should get the police report, photos of the intersection, witness contact details, and footage from nearby security or doorbell cameras. Some recordings may be deleted within days, so it helps to request them early.

In most cases, you have two years from the date of the crash to file a personal injury lawsuit in Texas. If you miss this deadline, you may lose your right to seek damages through the courts.

If the driver's insurance company disputes your claim, a pedestrian accident lawyer can collect the records and statements needed to support it. An attorney can also evaluate any settlement offer before you decide whether to accept it.
