Legal Options for Families After a Fatal Pedestrian Crash in Sugar Land, TX
When a pedestrian dies after being struck by a vehicle in Sugar Land, TX, eligible family members may be able to pursue a wrongful death claim. These claims can seek compensation for certain financial and personal losses resulting from the death. A separate survival claim may also be available through the deceased person's estate.
Under Texas law, a surviving spouse, children, and parents may generally bring a wrongful death claim. Potential damages can include lost financial support, loss of companionship and society, and mental anguish.
A survival claim may seek damages the deceased person could have pursued had they lived, such as certain medical expenses, lost earnings, and pain and suffering before death. The available damages depend on the evidence and applicable law.
In a pedestrian crash involving multiple vehicles, determining how the collision unfolded may require a careful review of the available evidence. Witness accounts, traffic signal records, roadway and vehicle damage, photographs, and any available video may help establish the sequence of events and the actions of those involved.
A criminal investigation, including any review of a driver's conduct, is separate from a civil wrongful death claim. Families may have civil legal options regardless of whether criminal charges are filed. Texas comparative responsibility rules may also affect a claim if the evidence shows that more than one party contributed to the crash.
Texas generally imposes a two-year deadline for filing wrongful death and survival lawsuits, although exceptions may apply. Families may wish to preserve records, identify witnesses, and obtain legal guidance about insurance coverage and filing deadlines.
