Who Can File a Wrongful Death Claim in Dallas, TX?
After a fatal pedestrian crash in Dallas, the person's surviving spouse, children, or parents may file a wrongful death claim if they meet legal requirements. Eligibility depends on the family's circumstances.
Under Texas law, biological children may qualify whether they are minors or adults. Adopted children and adoptive parents may also qualify, depending on the adoption and their legal relationship with the person who died.
If more than one family member qualifies, they can file a claim together. One or more can also file on behalf of everyone who has the right to seek compensation.
If no family member files within three months, the executor or administrator of the person's estate must bring the wrongful death claim unless all eligible family members ask otherwise. A survival claim is different.
Depending on the circumstances, your family may be able to recover compensation for lost financial support, the love and companionship you have lost, and the emotional pain caused by the death.
Families generally have two years from the date of death to file a wrongful death lawsuit. Some exceptions may affect this deadline. If you miss the applicable deadline, you may lose the right to file.
During the legal process, a wrongful death lawyer can look into the available insurance, explain filing deadlines, and determine which claims may apply. An attorney can also communicate with insurers while your family takes time to grieve.
