Can Families Recover Compensation After a Fatal Hit-and-Run Crash in Longview, TX?

Yes, families in Texas may be able to recover compensation after a fatal hit-and-run crash. One option is uninsured motorist coverage under the deceased person's or a household member's auto policy. Another is a wrongful death claim against the driver if that person is identified.

When a driver leaves after a fatal crash, witness accounts, nearby surveillance footage, and details about the vehicle can help police identify the person involved. This information may also help investigators determine where the vehicle went afterward.

Texas law allows the surviving spouse, children, or parents to file a wrongful death claim. If none of them files within three months of the death, the estate's representative may generally file unless the family asks the representative not to.

As part of a wrongful death claim, eligible family members may seek compensation for lost financial support, loss of companionship, mental anguish, and certain funeral expenses connected to the death.

Because the pedestrian survived long enough to receive medical care, the estate may also have a separate survival claim. This claim can address losses the person experienced before death, including medical expenses related to the final injury.

In Texas, families have two years from the date of death to file a wrongful death lawsuit. Insurance policies may require earlier notice, especially when uninsured motorist coverage may apply.

When the driver remains unidentified or insurance coverage is disputed, a wrongful death lawyer can review the available policies and explain which claims may apply. An attorney can also address insurer disputes and help keep filing requirements on track.
