Why Early Settlement Offers Deserve a Close Look in Montgomery County, TX
Insurance adjusters tend to reach out within days, sometimes before a person has finished seeing doctors. A quick offer may look generous, but it usually comes with a release. Once that document is signed, the claim is generally over, even if an injury later turns out to need surgery or months of therapy.
Texas law gives claimants some leverage in this process. Insurers must acknowledge and respond to claims from their own policyholders within set time limits, and they can face penalties for unreasonable delays.
When a claimant makes a clear offer to settle within the at-fault driver's policy limits, Texas law may hold the insurer responsible for a larger verdict later if it unreasonably turns that offer down. That rule usually shapes how and when serious negotiations begin.
Before you accept, it helps to know the full cost of medical care, lost income, and any future treatment. A car accident lawyer can compare an offer with medical records and policy limits, prepare a settlement demand with the terms Texas law expects, and point out release language that may reach further than it seems.
At Brian C. Gutierrez, PLLC, we can review your offer, release language, and policy limits to help you decide whether the number makes sense for your case.
