What Families May Recover in a Wrongful Death Claim in Austin, TX

Texas law lists several kinds of losses that family members can seek in a wrongful death claim. Those losses include pecuniary loss, loss of companionship and society, mental anguish, and loss of inheritance. Pecuniary loss generally means the money and practical support the person would likely have provided, such as income, benefits, and household services.

Some of these losses are easier to measure than others. Pay records, tax returns, and employment history can help show lost financial support, while companionship and mental anguish have no set formula and are usually described through testimony from the people closest to the person.

A wrongful death lawyer may bring in financial professionals to estimate long-term earnings, and that work typically shapes how a claim is valued before any offer is discussed.

A separate survival claim belongs to the estate and can cover medical bills, funeral costs, and conscious pain the person experienced before death. Texas also allows exemplary damages in some wrongful death cases when the conduct involved amounts to gross negligence or a willful act.

It is common that families have questions about which losses Texas law may allow them to seek after a death. At Brian C. Gutierrez, PLLC, we can walk through how damages in wrongful death and survival claims are generally measured and how they may apply to your case.
