Driscoll, TX (November 4, 2026) – A 37-year-old woman from Mabank was killed and four others were injured when an SUV rolled over on U.S. 77 north of Driscoll on Sunday afternoon, November 1.

The Texas Department of Public Safety reported that a 40-year-old driver from Canton was heading north on U.S. 77 at roughly 1:46 p.m. with four passengers: the woman, a 35-year-old woman, a 16-year-old girl, and a 12-year-old boy. The driver reported falling asleep, and the 2014 Hyundai Santa Fe went into the center median.

The driver tried to return to the road, but the SUV crossed the highway to the right shoulder and began to roll. The woman was thrown from the vehicle.

The SUV came to rest upside down in water. Passing drivers stopped and helped pull the driver and the other three passengers out. The Nueces County Medical Examiner's Office pronounced the woman dead at the scene. The two adults and the teenager were taken to Christus Spohn Shoreline, and the 12-year-old was taken to Driscoll Children's Hospital.

The Texas Department of Public Safety continues to investigate the crash.

We extend our deepest condolences to the family and loved ones of the woman who lost her life. We also hope everyone injured makes a full recovery.

How Long Do Families Have to File a Wrongful Death Claim in Driscoll, TX?

In Driscoll and throughout Texas, families generally have two years from the date of death to file a wrongful death lawsuit. The filing period is important even while the family is grieving.

Under Texas law, a wrongful death claim can be brought by a surviving spouse, child, or parent. If none files within three months, the estate's representative may file unless eligible relatives object.

Through a wrongful death claim, your family may qualify for compensation for lost financial support, companionship, care, mental anguish, and funeral expenses. The amount depends on the role your loved one played in the family.

If the deadline passes, a court may dismiss the lawsuit and your family may lose the opportunity to recover damages. Acting sooner also helps preserve records and information about the crash.

During this difficult time, a wrongful death lawyer can handle the filings, speak with insurers, and resolve disputes about compensation. An attorney can also explain who in your family may recover through the claim.
