How Fault Is Divided Among Drivers in Niederwald, TX
When three or more vehicles are involved in one crash, each driver may tell a different story about who braked, who swerved, and who hit whom first. Texas addresses that confusion through proportionate responsibility, a system in which a jury can assign a percentage of fault to each person involved. Those percentages can shape who pays, how much, and which insurance policies come into play.
Under the Texas Civil Practice and Remedies Code, a person's recovery is reduced by any percentage of responsibility assigned to them, and a person found more than 50 percent responsible generally cannot recover damages.
A defendant found more than 50 percent responsible can be held jointly liable for the full amount, while others are typically liable only for their own share. Texas also gives most people two years to file a personal injury lawsuit, so the timeline can matter when several insurers are involved.
Drivers share the road with many other vehicles, and each one can carry a different policy. Texas requires minimum liability limits of $30,000 per injured person and $60,000 in total for bodily injury, plus $25,000 for property damage, though actual coverage varies.
Sorting out which vehicle moved first usually depends on vehicle data, repair records, and witness statements. A car accident lawyer can help gather those materials before footage is overwritten or vehicles are repaired.
When fault is shared among several drivers, the paperwork and deadlines can pile up quickly. Our team at Brian C. Gutierrez, PLLC can explain how Texas proportionate responsibility rules may apply to each specific claim.
