How Do Wrongful Death Claims Work After a Fatal Crash Involving a Child in Cypress, TX?

In Texas, parents can usually file a wrongful death claim if their child dies in a crash caused by someone else's negligence. This allows your family to seek compensation for the losses you have experienced.

In addition to a wrongful death claim, your child's estate may bring a survival claim for losses your child experienced before passing away. These may include medical bills and any pain your child experienced before death.

Depending on the circumstances, your family may be able to recover compensation for funeral expenses, the loss of your child's love and companionship, and emotional pain. Medical expenses before death may be covered through a separate survival claim.

Under Texas law, you generally have two years from the date of your child's death to file a wrongful death lawsuit. Some exceptions may apply, but missing the deadline could mean losing your right to file a claim.

As the claim moves forward, a wrongful death lawyer can review the available evidence, identify who may be responsible, and address insurance issues. An attorney can also explain who has the right to file a claim and what steps your family may need to take.
