What Compensation Can I Recover After a Car Accident in Prairie View, TX?

After a car accident in Prairie View, TX, you may be able to recover compensation for medical bills, lost income, property damage, and pain and suffering if another driver negligently caused your injuries. What you recover depends on your losses.

To support your claim, crash reports and photographs can help explain what happened. Medical records, treatment bills, and wage statements can also show how your injuries have affected your health, finances, and ability to work. These records help support compensation.

Depending on your coverage, personal injury protection (PIP) or medical payments (MedPay) may help pay eligible expenses before your liability claim is resolved. Your health insurance may also cover treatment costs, depending on your policy. Coverage limits and exclusions apply.

When an insurance adjuster contacts you, provide accurate information without guessing about who caused the crash. Before giving a recorded statement, consider how your words could be used when the insurer evaluates your claim.

If you share responsibility for the crash, Texas law generally reduces your compensation according to your percentage of fault. You can recover damages if you are 50% or less responsible, but not if you are more than 50% at fault.

In Texas, you generally have two years from the crash to file a personal injury lawsuit, although exceptions may apply. Missing that deadline could prevent you from pursuing compensation through the courts. Acting early also helps preserve important records.

As your claim moves forward, a car accident lawyer can review your losses and determine what compensation may be available. An attorney can also handle negotiations with the insurance company while you focus on your recovery.
